The 7-month discovery log saga that nearly sank our case
We spent 7 months fighting over a missing email thread in a breach of contract case out of Austin. The other side kept saying they had no records, and our client was sure they existed. I finally got a court order for a forensic search, and it took a vendor 3 weeks to find the emails in an archived backup. The real lesson was that our initial preservation notice was too vague, so we lost early leverage. Has anyone else had a judge push back on discovery costs this hard?
