Our GC pushed me to arbitrate a $120k vendor fight in Chicago, and I owe him an apology
I fought him on it for two weeks because I figured arbitration was just a way for the other side to hide everything and screw us quietly. We had a breach of a supply deal worth about $120k with a parts company out of Chicago, and I wanted it in open court where I could put their emails in front of a jury. Turns out the arbitrator ran the whole thing in four months for around $18k in fees, versus the $200k and two years our last court case ate up. Now I am wondering how many other disputes we are dragging into litigation that should just go to arbitration, so if anyone has a rule for when to pick one over the other I would love to hear it.
One thing though, arbitration isn't always the cheap fast road. If the other side drags their feet on picking the arbitrator or the panel, you can burn months before anyone even hears the case. The four months you got is great but it's not guaranteed, so don't bank on that every time.
